Copyright & DMCA Policy

SongArc respects intellectual property rights and expects all users to do the same. Only upload audio, artwork, and other content you own or are authorized to use.

1. Your Responsibility for Uploaded Content

SongArc is a creative tool that processes audio files, artwork, and lyrics uploaded by users. You may only upload content that you own or that you are authorized to use under a valid license, permission, or applicable law (such as a mechanical license, sync license, or Creative Commons license).

Unauthorized uploads are strictly prohibited. This includes:

  • Uploading songs, recordings, or samples you do not own or have not licensed;
  • Uploading cover artwork, photographs, or visual assets you do not own or have not licensed;
  • Uploading lyrics owned by a publishing company without proper authorization;
  • Uploading any content that would constitute copyright infringement under applicable law.

You are solely responsible for ensuring you have all necessary rights, licenses, and permissions before uploading any content to SongArc.

2. Enforcement Actions

SongArc reserves the right to take any of the following actions in response to copyright concerns or violations:

  • Remove content: Delete or disable access to any uploaded content that is alleged or found to be infringing;
  • Block uploads: Prevent specific content from being re-uploaded after a takedown;
  • Suspend accounts: Temporarily restrict account access for users who upload infringing content;
  • Terminate accounts: Permanently terminate the accounts of repeat infringers in accordance with our Repeat Infringer Policy (see Section 4).

3. DMCA Takedown Process

SongArc responds to copyright infringement complaints submitted in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe that content uploaded to SongArc infringes your copyright, you may submit a takedown notice to our designated copyright agent.

To submit a valid DMCA takedown notice, your request must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material you claim is infringing, with sufficient detail for us to locate it (e.g., a URL or description);
  4. Your contact information: name, address, telephone number, and email address;
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

4. Repeat Infringer Policy

SongArc maintains a strict repeat infringer policy. Users who are found to have uploaded infringing content on multiple occasions will have their accounts suspended or permanently terminated. We track copyright complaints and takedown actions against each account. Repeat infringers — generally defined as users who receive two or more substantiated DMCA takedown notices — will be subject to account termination.

SongArc also reserves the right to terminate accounts of first-time infringers when the circumstances warrant it, such as in cases of egregious or willful infringement.

5. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification. A valid counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the content that was removed and the location where it appeared before removal;
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification;
  4. Your name, address, telephone number, and email address;
  5. A statement consenting to the jurisdiction of the federal district court for your address, and that you will accept service of process from the person who filed the original takedown notice.

Submit counter-notifications to songarc@polsia.app. If a valid counter-notification is received, we may restore the removed content after 10–14 business days unless the complaining party files a court action.

6. Good Faith and Misuse

Filing a false DMCA takedown notice or counter-notification is a federal offense. If you knowingly and materially misrepresent that material is infringing or that material was removed by mistake, you may be liable for damages and attorneys' fees. Please only submit takedown notices or counter-notifications if you have a genuine good faith basis to do so.
